EmployeeBuddy.com User Agreement
Your access to and use of
www.EmployeeBuddy.com (the "Site") and the services provided through the Site are governed by this EmployeeBuddy.com User Agreement ("Agreement"). Your use of the Site indicates your acceptance of the terms of this Agreement.
Please do not use this Site in any manner if you do not agree with the terms of this Agreement. EmployeeBuddy.com, (“us”, “we” or “EmployeeBuddy.com, ”) reserves the right to modify and update the terms of this Agreement by posting a new version of this Agreement on this web page. Keeping abreast of the new terms of this Agreement is the user’s responsibility, and the user’s continued use of this Site signifies the user’s acceptance of any changed terms. For a period of 30 days following the posting of new terms or changes to the Agreement, the word “New!” will appear beside the link to the User Agreement in small, red letters.
Privacy Policy: EmployeeBuddy.com respects our users’ privacy and has implemented policies to protect it. Job Seekers wishing to post a profile on our site will be required to provide certain personally identifiable information. We ask that job seekers only post their first name, that they never post any address or phone information, and never post the name of their current employer. If you are a user using our Job Seeker Profile feature, you will be asked to enter information regarding your skills, experience and interests. By default, your profile will be public and by creating a profile you understand and agree that is a profile available to anyone on the internet. We do not make users’ emails publicly available nor do we sell, lend or otherwise misuse them for any purpose to any third party. Other users can contact Job Seekers after reading their profiles through the Site. After the initial contact, users can pursue further communications by email, outside of our Site, in order to exchange resumes and/or additional information about specific employers and job opportunities. Although we have no control over communications between users outside of the Site, we require that users behave with respect to each other’s privacy, lawfully, and generally assuming the professional attitude as expected in the context of job recruitment in the United States. Age requirement: The minimum age for use of the Site is eighteen (18) years old. Use of the Site is void where prohibited. By using this Site, you represent that you have the capacity to enter into this Agreement and to abide by all of the terms of this Agreement.
Duration: The terms of this Agreement will be in effect for the entire duration of your use of the Site. EmployeeBuddy.com may suspend your account at any time, with or without notice, if you are found to be in violation of this Agreement. If you terminate your account or your account is suspended, some terms of this Agreement will remain in effect as applicable.
Use: Your use of the data included on this Site is only for the purpose stated on the Site. This Agreement forbids you from using the information contained on the Site for any other purpose. Your use of the Site signifies you agree never to distribute, publish, transmit, modify, display, or attempt to profit from the contents of this Site in any way other than for the purpose of seeking employment or seeking to refer a job candidate to your employer.
Site Content: EmployeeBuddy.com has power of review or deletion over any Content posted on the Site. Content that we deem offensive, illegal or that might harm, threaten, spam or annoy others, or content that is blatantly untrue or harmful to the Site or to the reputation of the Site or that of other users, can be removed by us at any time without notice. By posting your Content to any part of the Site, you automatically grant (and you represent that you have the right to grant) to us an irrevocable, perpetual, non-exclusive, transferable, worldwide license to display and distribute such Content. You may remove your Content from the Site at any time. As stated in other parts of this Agreement, we may remove your Content at any time. However, EmployeeBuddy.com cannot guarantee that your Content will be removed from the Internet as independent search agents we do not control routinely may retain and display a copy of a web page that EmployeeBuddy.com has removed.
Publicly Available Content: All users understand that any Content they post to the Site will be publicly available to anyone on the Internet and may be easily found through any means through which information available on the internet can be found.
Job Seekers: All job seeker profiles must be for legitimate, lawful, current or future United States residents currently seeking a job. Your profile must truthfully describe you, an individual person. You are solely responsible for the Content that you communicate on or through the Site. You agree that you will not post any Content on this Site or engage in any communication through this Site that is prohibited by this Agreement.
Others: Contacting a job seeker for any of these types of positions is
expressly forbidden:
-jobs with compensation based solely on commission,
-volunteers, or any job without monetary compensation
-jobs that involve illegal activities,
-jobs in the sex industry,
-business opportunities disguised as jobs,
-any position which requires payment from the applicant,
-any position which requires recruitment of other individuals such as in a pyramid scheme or network marketing scheme.
You have the right to report any user, communication or information from a user that you find inappropriate by e-mailing our service department. You are solely responsible for your interactions with other users of the Site. EmployeeBuddy.com reserves the right, but has no obligation, to monitor and mediate disputes between you and other users. We forbid any behavior or communication on the site or through the site that has a discriminatory, illegal, offensive, harmful, pornographic, slanderous or libelous nature both in terms of applicable laws and generally accepted norms of society.
You should be aware that there is a chance that in using this Site, you might be exposed to such items or behavior and, to the maximum extent allowed by law, you further waive your right to any damages (from any party) related to such exposure. You agree to use this Site in a manner consistent with any and all applicable laws and regulations.
You agree that you must evaluate, and bear all risks associated with, your use of any content posted, emailed or otherwise made available via the Site. You agree that EmployeeBuddy.com does not verify the authenticity of information posted on the Site or sent through the Site. You acknowledge and understand that EmployeeBuddy.com does not pre-screen or approve content and that content is posted by individual users.
Under no circumstances will EmployeeBuddy.com be liable in any way for any content posted on the Site or communicated through the Site, including any loss or damage of any kind incurred as a result of your use of the Content on the Site.
Spam: Advertising or solicitation through the Site is prohibited. No unsolicited mass emails are allowed to be sent through or as a result of the Content on the Site. Although EmployeeBuddy.com cannot monitor the conduct of its users off the Site, it is also a violation of these terms to use any information obtained from the Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any person whether that person is a user or not.
Termination of Service: You agree that EmployeeBuddy.com , in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Site immediately and without notice, and remove and/or destroy any Content within the Site or Service, for any reason, including, without limitation, if EmployeeBuddy.com believes that you have acted inconsistently with the terms of this Agreement. You agree that EmployeeBuddy.com shall not be liable to you or any third party for any termination of your access to the Site or Service. You agree not to attempt to use the Site or Service after said termination.
Job Seeker Profile Service: You may use our Job Seeker Profile Service by following the Job Seeker Profile Creation instructions and providing us with all required information. If you use our Job Seeker Profile Service, you agree to comply with the terms of this Agreement. You may terminate your use of the Job Seeker Profile Service at any time by deleting your personal profile.
Jurisdiction: This Agreement shall be governed by the laws of the State of Wisconsin. Any dispute arising from or related to this Agreement or the use of the Service or Site shall be resolved exclusively in the state and federal courts located in Dane County, Wisconsin, and you agree to submit to the exclusive jurisdiction of and venue in such courts. EmployeeBuddy.com makes no representation that materials on the Site are appropriate or available for use in locations outside the United States.
Links: Some links on the Site will allow you to connect with Sites that are not under EmployeeBuddy.com ’s control. These links can either be posted by us or by users in their profiles. EmployeeBuddy.com does not endorse nor is it responsible for the contents of any linked site. You access the linked sites at your own risk.
Intellectual property: This Agreement does not transfer from EmployeeBuddy.com to you or any user any proprietary technology developed and/or owned by EmployeeBuddy.com or any intellectual property rights owned or otherwise held by EmployeeBuddy.com , including incorporated into or used to provide the Service. Regarding any feedback you provide us regarding the Site ("Feedback"), you hereby grant to EmployeeBuddy.com a nonexclusive, perpetual, irrevocable, royalty-free, fully-paid worldwide license to use, reproduce, sublicense, modify, adapt, distribute and otherwise exploit such Feedback.
You agree not to post on or transmit through the Site any information that you deem confidential with a view to intellectual property that you own or think you own or are considering making a claim of ownership in. Information posted on our Site is publicly available on the internet to anyone, therefore you agree not to post or send information through the Site you wish to keep private. EmployeeBuddy.com respects intellectual property and expects all users to do the same. Any user found to violate the intellectual property rights of others on or through the Site will cease to have the right to use the Site.
Indemnity: You agree to indemnify, defend and hold harmless EmployeeBuddy.com from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses arising out of any unauthorized uses you may make of any material on the Site or any breach by you of this Agreement.
No Warranty: Use EmployeeBuddy.com at your own risk. The service provided by our Site is provided on an “as is” basis. We reserve the right to end or change the service on the Site with notice posted on the Site. We do not make and expressly disclaim any and all other express or implied warranties. We make no claim that the Site will be uninterrupted, error-free, or completely secure.
Limitation of Liability: You agree that EmployeeBuddy.com shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages resulting from: your use or inability to use the Site, authorized or unauthorized access to or alteration of your Content or transmissions, statements or conduct of third parties acting through the Site, or any other matter relating to the Site.
Copyright and Trademark: Unless otherwise noted, all materials on this Site are protected as the copyrights, trade dress, trademarks, service marks, and/or other intellectual property owned by EmployeeBuddy.com or by other parties that have licensed their material to EmployeeBuddy.com . All rights not expressly granted are reserved by EmployeeBuddy.com , Inc.
This Agreement represents the entire Agreement between you and EmployeeBuddy.com with respect to the subject matter hereof.
